By accessing or using PropertyBlasters ("Service"), operated by PropertyBlasters LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
PropertyBlasters provides an email marketing platform that enables real estate professionals to create and distribute listing flyers to real estate agents via email. The Service includes template design tools, email list targeting, delivery services, and analytics reporting.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it updated.
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to:
You agree not to use the Service to send content that is false, misleading, discriminatory, defamatory, obscene, or that violates any person's intellectual property rights.
You are solely responsible for the content of your email flyers. PropertyBlasters does not review all content prior to distribution but reserves the right to refuse, suspend, or terminate distribution of any content that violates these Terms or applicable law.
The Service operates on a credit-based system. Credits are purchased in advance and are non-refundable except as specified in our Refund Policy. Subscription plans auto-renew unless cancelled before the renewal date. Unused credits on subscription plans expire at the end of each billing cycle unless otherwise stated.
The agent email database maintained by PropertyBlasters is proprietary. You may not extract, download, scrape, or export email addresses from our database. The database is provided solely for use through the PropertyBlasters platform.
All templates, designs, software, and content provided by PropertyBlasters are owned by PropertyBlasters LLC and protected by copyright and other intellectual property laws. You retain ownership of content you create or upload (photos, text, logos). By uploading content, you grant us a limited license to process and distribute it through the Service.
The Service is provided "as is" and "as available." We do not guarantee specific open rates, delivery rates, or results from any email campaign except as explicitly stated in our delivery guarantee. We make no warranties, express or implied, regarding the accuracy of our agent database or the suitability of the Service for your particular needs.
To the maximum extent permitted by law, PropertyBlasters LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless PropertyBlasters LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.
We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time by contacting support. Upon termination, unused credits are forfeited unless otherwise required by law.
We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.
